Terms of service

These terms and conditions of sale are entered into between:

- ANNABLUE SRL (with its full contact details), and
- Any natural or legal person wishing to make a purchase via the website www.mantique.be (hereinafter “the Customer”).

OBJECT

These conditions define the contractual relationship between ANNABLUE and the Customer, as well as the terms applicable to any purchase made through the online store mantique.be, whether the Customer is a professional or a consumer.

By purchasing through this site, the Customer unreservedly accepts these conditions. They prevail over any other general or special conditions not expressly approved by ANNABLUE.

ANNABLUE reserves the right to modify these conditions at any time. The version in force on the date the Customer places their order will apply.

CHARACTERISTICS OF THE GOODS OFFERED

Products offered are those listed in the collections published on www.mantique.be.

Availability is subject to stock limits.

PRICES

Catalog prices are shown in euros, VAT included at the rate applicable on the day of the order. Any change in the VAT rate may be passed on to the price of products or services.

ANNABLUE may change prices at any time, but the price in effect on the day the Customer’s order is placed will apply.

Prices include order processing fees but exclude packaging and delivery charges, which vary by weight and destination. Shipping costs are calculated automatically and displayed in the shopping cart.

GEOGRAPHIC SCOPE

Online sales are reserved for Customers residing in Belgium, Luxembourg, France, the Netherlands, Germany, Italy, Spain, and Portugal.

ORDERS

To place an order, the Customer must:
Complete the identification form with all required details;
Accept these terms and conditions;
Review and confirm their order;
Make payment under the specified conditions;
Confirm their order and payment.

Order confirmation signifies acceptance of these terms, acknowledgment that the Customer has read them, and renouncement of any other purchasing conditions.

The data provided and the recorded confirmation constitute proof of the transaction. ANNABLUE will email the Customer a confirmation of the registered order.

LEGAL WARRANTY

Unless proven otherwise, any lack of conformity appearing within six months of delivery is presumed to have existed at delivery, except where this presumption is incompatible with the nature of the goods or defect, taking into account whether the goods are new or used (Art. 1649quater § 4).

RIGHT OF WITHDRAWAL

In accordance with distance-selling legislation (Book VI of the Economic Law Code of May 31, 2014), the Customer has the right to withdraw from their purchase without penalty and without giving any reason.

The Customer has 14 calendar days from receipt of the products to return them to ANNABLUE for exchange or refund (excluding delivery costs).

To obtain a refund or exchange, the Customer must return new products, at their own expense and risk, in their original, intact packaging with all accessories, to:

Article VI.53 of Book VI of the Economic Law Code excludes the right of withdrawal for:

- Goods made to the Customer’s specifications (e.g., loose medicinal plants)
- Sealed goods that cannot be returned for health or hygiene reasons once unsealed by the Customer

If returned under these conditions, ANNABLUE will refund amounts paid (excluding delivery costs) free of charge. If ANNABLUE originally covered delivery costs (e.g., free-shipping promotion), those costs will be deducted from the refund. Refunds are issued within 14 days of receipt by ANNABLUE SRL.

PAYMENT TERMS

Product prices are payable in full by one of the payment methods offered on the site at the time of order.

Fraud protection is ensured by Shopify Payments or PayPal.

Orders become effective once the secure payment center and Customer’s bank authorize the transaction. In case of refusal, the order is automatically canceled, and the Customer is notified by email.

Order information is processed automatically by Shopify Payments or PayPal to fight card-fraud. Failure to transmit required data prevents transaction processing. In case of fraud or dispute, order details may be recorded in a payment incident file.
- The delivery note is included in the package.
- Invoices are sent by email with the shipment notice and are downloadable in PDF format.

DELIVERIES

Deliveries are made to the address indicated on the order form, within the agreed geographic area.

The Customer is responsible for the accuracy of the delivery address. ANNABLUE does not modify addresses; shipping labels are generated automatically.

For transport damage, the Customer must file a claim with the carrier within three days of delivery.

Delivery times are indicative. If they exceed 15 days from order date, the sales contract may be canceled and the Customer refunded.

All claims, exchange, or refund requests must be sent by post within one month of delivery to:

LIABILITY

ANNABLUE’s online sales obligation is one of means only. ANNABLUE cannot be held liable for Internet-related issues such as data loss, intrusion, viruses, service interruptions, or other involuntary problems.

INTELLECTUAL PROPERTY

All elements of the ANNABLUE site are the exclusive intellectual property of ANNABLUE SRL. No one may reproduce, exploit, distribute, or use them in any form without express written consent. Hyperlinks to the site require prior written approval.

PERSONAL DATA

Collection of personal data is mandatory for processing and delivering orders. Failure to provide data prevents order validation.

ANNABLUE complies with Belgian law of December 8, 1992, as amended, regarding personal data. Data collection requires consent, must be accurate, and serve a specific legal purpose.

Customers have the right to access, modify, correct, or delete their personal data by requesting via our contact form.

ARCHIVING

ANNABLUE archives order forms and invoices on a reliable, durable medium, constituting a faithful copy of transactions. These electronic records are deemed proof of communications, orders, payments, and transactions.

DISPUTE RESOLUTION

In case of difficulties applying this contract, the Customer and ANNABLUE agree to seek an amicable solution before any legal action. If a dispute remains, the Customer may use the EU Online Dispute Resolution platform via contact@mantique.be. Otherwise, only the courts of Nivelles (Belgium) have jurisdiction, regardless of the delivery location or Customer’s domicile. All contracts and legal relationships between ANNABLUE and the Customer are governed by Belgian law.
